OFFICIAL SWEEPSTAKES RULES

FOR TWO YEAR LEASE OF A TOYOTA RAV4

NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

This Sweepstakes starts at 12:01 am (ET) on September 12, 2016 and ends at 4:00 pm (ET) on Saturday, October 3, 2016 (“Sweepstakes Period”). All Facebook entries must be registered between 12:01 A.M. on September 12, 2016, and 11:59 P.M. on September 25, 2016. All entries registered in person at the Toyota Dealers booth display at the Bloomsburg Fair must be registered between 12:01 A.M. on September 26, 2016, and 4:00 P.M. on October 3, 2016.

1)    Eligibility: This Sweepstakes is open to legal U.S. residents who are 18 years and older and hold a valid driver’s license as of the first day of the Sweepstakes Period. Employees and Board Members (and their immediate family members as defined below) of Sponsor and of its parent companies, affiliates, subsidiaries, advertising agencies, prize providers (including without limitation Central Atlantic Toyota Dealers Advertising Association, Inc., hereinafter “CATDAA” and its member Toyota dealerships and Central Atlantic Toyota Distributors, Inc.), promotion contractors and/or public relations companies associated with this Sweepstakes, are not eligible to participate. “Immediate family members” includes, for purposes of this Sweepstakes, spouse, children (including step-children), grandchildren (including step grandchildren) and each of their respective spouses. A potential winner will be requested to provide proof that all eligibility requirements are met. This Sweepstakes will be governed and enforced pursuant to Pennsylvania law, including choice of law provisions. This Sweepstakes is void where prohibited.

2)    How to enter: You may enter by accurately completing an entry form available at the Toyota booth display at the Bloomsburg Fair on or before 4 PM (ET) on Saturday, October 3, 2016. You may also enter by registering online at Bloomsburg Fair Facebook. ALL ENTRIES REGISTERED VIA FACEBOOK MUST BE MADE ON OR BEFORE 11:59 P.M. ON SEPTEMBER 25, 2016. Entrant’s name, address, telephone number and email address, if any, must be provided to constitute an eligible entry. Limit 1 entry per person. Your contact information must be accurate and legible. Incomplete entries will be disqualified, and Sponsor is not responsible for entries that are lost, late, illegible or improperly completed or submitted. All received entries become the property of the Bloomsburg Fair Association and will be shared by the Bloomsburg Fair Association with NE PA Toyota Dealers. NO PURCHASE IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

3)    Odds of Winning:  The odds of being selected a Finalist depend on the number of eligible entries submitted. Since the first round drawings are on different days using eligible entries submitted up to the deadline for each drawing, the odds of being a finalist will be different for each first round drawing. One Grand Prize winner will be selected from the four Finalists.

4)   Selection of Winner/Notification:

I.  First round winners (“Finalists”) shall be selected from eligible entries as follows:

(a)  On Sunday, September 27, 2016, at 5:00 P.M., finalist number 1 shall be selected at random from all eligible entries submitted between the start of the Sweepstakes and 5:00 P.M. on September 27, 2016. Sponsor will attempt to confirm this first round winner by telephone using the information on the entry form. In the event Sponsor is unable to confirm this Finalist prior to 5:00 P.M. on Monday, September 28, 2016, this Finalist shall be deemed disqualified and another eligible entry shall be selected from all of the entries and the Sponsor will attempt to confirm this finalist by telephone by 5:00 P.M. on Tuesday, September 29, 2016.

(b)  On Thursday, September 29, 2016, at 5:00 P.M., finalist number 2 shall be selected at random from all eligible entries submitted between the start of the Sweepstakes and 5:00 P.M. on September 29, 2016. Sponsor will attempt to confirm this first round winner by telephone using the information on the entry form. In the event Sponsor is unable to confirm this Finalist prior to 5:00 P.M. on Friday, September 30, 2016, this Finalist shall be deemed disqualified and another eligible entry shall be selected from all of the entries and the Sponsor will attempt to confirm this finalist by telephone by 5:00 P.M. on Saturday, October 1, 2016.

(c)  On Friday, September 30, 2016, at 5:00 P.M., finalist number 3 shall be selected at random from all eligible entries submitted between the start of the Sweepstakes and 5:00 P.M. on October 2, 2016. Sponsor will attempt to confirm this first round winner by telephone using the information on the entry form. In the event Sponsor is unable to confirm this Finalist prior to 11:00 A.M. on Saturday, October 1, 2016, this Finalist shall be deemed disqualified and another eligible entry shall be selected from all of the entries and the Sponsor will attempt to confirm this finalist by telephone by 3:00 P.M. on October 1, 2016.

(d)  On Saturday, October 1, 2016, at 4:00 P.M., finalist number 4 shall be selected at random from all eligible entries submitted between the start of the Sweepstakes and 4:00 P.M. on Saturday, October 1, 2016. Sponsor will attempt to confirm this first round winner by telephone using the information on the entry form. In the event Sponsor is unable to confirm this Finalist prior to 5:00 P.M. on Saturday, October 1, 2016, this Finalist shall be deemed disqualified and another eligible entry shall be selected from all of the entries and the Sponsor will attempt to confirm this finalist by telephone by 5:30 P.M. on October 1, 2016.

All four first round winners shall receive two free tickets to the Josh Turner and Sara Evans show plus reimbursement for two admission tickets ($8.00 each) and parking ($5.00).

II.  The Grand Prize winner shall be selected at random from the four Finalists at 6:45 P.M. on Saturday, October 3, 2016, at the Main Grandstand immediately prior to the Josh Turner and Sara Evans show.

5) The Prize: One Grand Prize: One two (2) year lease of a new 2016 Toyota RAV4 4-Door, non-hybrid, standard package (referred to in these rules as “Grand Prize” or “Prize”).

The Prize is not transferable, and there is no substitute or cash equivalent prize. Sponsor shall reimburse the Winner for all federal, state and local income tax actually incurred by the Winner in connection with the Prize provided that the Winner has timely and accurately provided Winner’s full name, address, Social Security Number and such other information reasonably requested by Sponsor. NE Pa. Toyota Dealers shall pay any applicable sales tax. Winner must present a legally valid driver’s license and proof of insurance and must establish compliance with the eligibility requirements in order to claim the Prize. No manufacturer or other incentives will be available to the Winner in connection with the Prize vehicle.

The Prize vehicle shall be provided free of all ordinary lease signing costs, lease transaction taxes, registration fees and monthly charges. The Winner shall be solely responsible for and shall pay for insurance costs, excess wear and tear costs, maintenance costs, excess mileage charges, operating expenses, mechanical repair costs not covered by warranty, damage to the Prize vehicle or other property or persons and lease costs associated with use of the Prize vehicle beyond the term of the lease. The Winner shall comply with all insurance requirements set forth in the Motor Vehicle Lease Agreement for the Prize vehicle and shall cause his or her policy of liability insurance for the Prize vehicle (i) to name Toyota Financial Services, Inc. (“TFS”) as an additional insured under such policy, and (ii) to name TFS as the loss payee with respect to the Prize vehicle. The Winner’s insurer must give TFS at least ten (10) days written notice before any cancellation of or reduction in coverage. Written proof of compliance with the foregoing shall be provided to the Sponsor. Failure to maintain adequate insurance will result in cancellation of the lease for the Prize vehicle. The Prize vehicle shall be delivered to the Winner at a Toyota dealership within the Commonwealth of Pennsylvania in the vicinity of the Winner’s place of residence. Upon termination or expiration of the lease for the Prize vehicle, the Winner shall immediately return the Prize vehicle to the Toyota dealership at which it was delivered to the Winner.

All expenses not specifically mentioned are the responsibility of the Winner. A properly claimed Prize will be awarded, but in no event will Sponsor award more prizes than are provided for in these Official Rules.

6)  Other Conditions: Winner will be required to sign and return an Affidavit of Eligibility and Release and any required documentation must be signed and returned to Sponsor within two weeks of the date Sponsor sends it to the Winner. Failure to return such documentation will result in that Winner being disqualified, in which case Sponsor will randomly draw another winner from among the remaining Finalists. This process will be repeated until a Finalist is declared the Winner of the Grand Prize.

By entering, entrants agree to release, waive and hold harmless Sponsor and CATDAA and each of their affiliates, subsidiaries, parent corporations, members and advertising and promotional agencies, and all of their officers, directors, shareholders, employees, members and agents from any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney’s fees) resulting from the entrants’ participation in this Sweepstakes, their acceptance, use, or misuse of the Prize or element thereof, and any travel or event-related activity in connection with the Sweepstakes. Sponsor is not responsible for printing or typographical errors in any Sweepstakes-related materials. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay or omission by Sponsor in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsor’s right to assert or rely upon any such provision or right in that or any other instance.

By entering this Sweepstakes, entrants agree to allow, to the extent permitted by law, use of their name, voice, photograph, likeness and any information provided on the entry form, in any medium of communication, including print, Internet, radio and/or television and for any purpose, including advertising, promotional or other purposes, by Sponsor and CATDAA and their affiliates or licensees, without additional compensation.

7)  Arbitration/Choice of Law:

Except where prohibited, entrants agree that (1): any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, or the determination of the Finalists or winner shall be resolved individually, without resort to any form of class action, and exclusively by arbitration in accordance with the Pennsylvania Arbitration Act by a single arbitrator appointed by the Court of Common Pleas of Columbia County, Pennsylvania; and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorney’s fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without regard to that jurisdiction’s conflicts of law doctrine, and all proceedings shall take place in Columbia County, Pennsylvania.

Winner acknowledges that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relating to the Prize.

8)  Fraud/Tampering: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES WILL RESULT IN DISQUALIFICATION. Sponsor reserves the right to prohibit any entrant from participating in the Sweepstakes if, at its sole discretion, Sponsor finds such entrant to be tampering with the entry process or the operation of the Sweepstakes, or if such entrant shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner the Sponsor determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or Sponsor; or (c) in any other disruptive manner. Sponsor assumes no liability for: (a) any incorrect or inaccurate entry information; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; or (d) inaccessibility or unavailability of the Internet or the Sponsor’s website or any combination thereof.

9)  Winner: To obtain the name of the Winner, please submit a written request for same, together with a self-addressed, stamped envelope, by October 31, 2016 to The Bloomsburg Fair (Toyota Sweepstakes), 620 West Third Street, Bloomsburg, Pa. 17815

10)  Sponsor: The Columbia County Agricultural, Horticultural & Mechanical Association, a/k/a The Bloomsburg Fair Association, 620 West Third Street, Bloomsburg, Pa. 17815.

One Finalist to be chosen each day at random drawings on Sunday, Wednesday, Friday and Saturday. Finalists must be present at drawing at 6:45 P.M. at Main Grandstand Stage to win the Grand Prize, a Two Year Lease of a 4-Door 2016 RAV4, non-hybrid standard package. Sponsor shall pay income tax associated with Grand Prize. Odds of winning depend on number of eligible entries for each drawing.
